 UKSC 19 UKSC 2015/0143 Financial Conduct Authority (Appellant) v Macris (Respondent) On appeal from the Court of Appeal (Civil Division) (England and Wales) The Financial Conduct Authority issued a warning notice, a decision notice, and a final notice to an investment bank, informing the bank that it was imposing a fine as a result of losses incurred in a trading portfolio. Mr Macris had a role in the management structure of the portfolio. Although the notices did not name Mr Macris, he argued that there were references to a part of the bank's management structure which identified him and that he should therefore have been given third party rights in relation to the notices under s.393 of the Financial Services and Markets Act 2000. The Upper Tribunal and Court of Appeal held Mr Macris was identified by the notices. The issue in this case concerned the meaning of the words "any of the reasons contained in [a notice] relates to a matter which identifies a person" in s.393(1) and (4) of the Financial Services Markets Act 2000. By a majority of 4 to 1, the Supreme Court allows the FCA’s appeal.

In a letter sent to market participants looking to offer cryptocurrency investment opportunities, the regulator said the “risks” associated with them meant that such companies could fall short of any licensing obligations. “The AFM has serious doubts, partly because of the risks associated with cryptos and their management,” the letter reads. Cryptocurrency investment is not subject to regulation under the Netherlands’ Financial Supervision Act, but certain activities may require providers to obtain a licence from the AFM. With the sounding of the gong AFM highlights their 2016-2018 agenda which will be published later this month. As an independent market conduct authority, the AFM contributes to a sustainable financial system and prosperity in the Netherlands. Since 2011, Everts is a member of the Executive Board. His main areas of responsibility are: supervision on securities markets, asset managers and accountant organizations, financial infrastructure, corporate governance, financial reporting and auditing. The reason for his visit to Beursplein 5 is the AFM agenda 2016-2018. Due to social and technological developments, financial markets are continuously evolving. South African President Jacob Zuma has signed in to law the Financial Sector Regulation Act, also known as "Twin Peaks". This will establish a prudential regulator and a separate, dedicated market conduct regulator. The prudential regulator will oversee risks taken on by financial firms such as banks and focus on macro-prudential aspects of financial stability. It will be housed in the South African Reserve Bank. The Financial Services Board will become a dedicated market conduct regulator, tasked with ensuring consumers are treated fairly and financial firms' conduct complies with law. The Presidency said the act would also ensure co-operation between the financial sector regulators, the National Credit Regulator, the Financial Intelligence Centre and the central bank. De Vries (1972) has been on the Executive Board since 1 October 2015 and has been appointed for a period of four years. As board member, her responsibilities include the departments that monitor the quality of financial services and the behavior of banks and insurers. She joined de Nederlandsche Bank (DNB) in 2003, initially as a Supervisor, and later as Head of department and Division Director. Subsequently, she became Secretary-director, in which position she managed the internal operations of DNB. As Division Director she was first responsible for supervising pension funds and investment firms, and subsequently for the Division supervisory expertise centers. In this position, she played a key role in changing the supervisory culture at DNB. Since March 2015, Dr. de Vries has been Professor by Special Appointment of Regulatory Enforcement at the University of Groningen. In her research and teaching work, she focuses on supervisory developments relating to such issues as how transparency and the effects of supervision can boost compliance with the set norms and help to satisfy society’s expectations in this context.

Merel van Vroonhoven (1968) has been a member of the Supervisory Board of Dutch Railways since 2009, prior to which she worked at ING. There, she was responsible, as member of the General Management of Nationale Nederlanden, for the Collective Pensions Operations from 2002 to 2007, and from 2007 onwards as member of the management committee of ING Investment Management Europe. Van Vroonhoven is the successor to Ronald Gerritse, who died on 26 September 2013.
