Individual Rewards in Organizations
Rewards are among the most powerful things managers can use to motivate behavior. The reward system consists of all organizational components - including people, processes, rules and procedures, and decision-making activities - involved in allocating compensation and benefits to employees in exchange for their contributions to the organization. The purpose of the reward system in most organizations is to attract, retain, and motivate qualified employees. The organization’s compensation structure must be equitable and consistent to ensure equality of treatment and compliance with the law. Compensation should also be a fair reward for the individual’s contributions to the organization, although in most cases these contributions are difficult, if not impossible, to measure objectively. Given this limitation, managers should be as fair and as equitable as possible. Most organizations use several different types of rewards. The most common are base pay (wages or salary), incentive systems, benefits, perquisites, and awards. For managers to take full advantage of the symbolic value of pay, there must be a perception on the part of employees that their rewards are linked to their performance.

State laws require most employers to provide workers’ compensation coverage by purchasing insurance from a private carrier, state insurance fund, or self-insuring. Workers’ compensation are security benefits provided to workers who are injured on the job. Workers’ compensation regulations require employers to provide cash benefits, medical care, and rehabilitation services to employees for injuries or illnesses that occur within the scope of their employment. In exchange, employees give up the right to pursue legal actions and awards. However, various circumstances may influence a company’s obligation to pay workers’ compensation. The concepts of no-fault insurance and exclusive remedy balance the rights of employers and employees under workers’ compensation. No-fault insurance means that an injured worker receives benefits even if the accident was the employee’s fault. Exclusive remedy means that workers’ compensation benefits are the only benefits injured workers may receive from the employer to compensate for work-related injuries. In most instances, an injured worker cannot file a lawsuit for additional money. Workers’ compensation programs are funded at the employer’s expense; workers cannot be required to make financial contributions for this coverage. Since each state operates independently, employers must be aware of various regulations if they operate in multiple states.

There's an exchange of documents between the parties so that both parties have the same documents proceeding forward to trial. At this stage, your solicitor can organize an informal conference between the parties to try and settle the claim. In other cases it's more appropriate to go forward with court proceedings. The difference between prostitution and solicitation is; prostitution is actually engaging in a sexual act in exchange for money or other compensation (like drugs). Solicitation is agreeing to engage in an act of prostitution. What's the penalty for prostitution? As with most other misdemeanors in the State of California, the penalty for prostitution is a maximum sentence of six months in the county jail, fines, sometimes probation, etc. One collateral consequence of prostitution is that it goes onto one's criminal record. A lot of people are ashamed that they got arrested for prostitution or solicitation, and they don't want that to affect their future. It becomes the goal of the criminal defense attorney (myself) to go in there and make sure that that doesn't happen. So when they get into a job interview, they aren't explaining away why they got arrested for prostitution, instead they can focus on their résumé and qualifications. What happens if the prosecution can prove that somebody committed an act of prostitution? Even if the prosecution can prove that an individual committed an act of prostitution, all is not lost. A lot of times, I can go to the judge, the prosecutor, and say "my client is a working individual, he/she has a career, he's not the typical criminal who is in and out of the criminal courts." I can highlight those aspects about the case, about my clients and get them in a diversion program. What is involved in a diversion program for prostitution or solicitation? In San Diego County, a typical diversion program for prostitution or solicitation is the requirement that the individual take some HIV/AIDS counseling, some tests, and also to learn about the dangers and issues going on with prostitution in San Diego County so that they don't do it again. Sometimes if you successfully complete a diversion program by taking the required classes and tests, you can get a case dismissed, reduced to an infraction, or reduced to a lower charge which isn't going to have the same social stigma that a prostitution or solicitation charge might have. Shawn Moninger Hello Unity Friends and Family, We are told to get with all of our getting to get understanding. This week, let's look at getting understanding about the law of compensation. Charles Fillmore defines it as "The order which one receives just remuneration. The law of compensation is universal and not subject to personal demands. If the mind is turned toward man as one's recompense, it is turned away from divine law." What this means is that God is our Source and not other people. If the word God doesn't work for you, use the word Principle. Principle is our Source and not people. You could also say Divine Law is our Source and not people. Our Source is within and people can be channels. They can be great channels but a person, a government, a bank, or anything outside of ourselves will never be the Source. Compensation comes through an exchange of energy. Often, we hear people complain that they are unfairly compensated for what they do. I can understand that thought...as long as one believes their work (employer) is their source. If one believes God is their Source they know that they will do what ought to be done by them and they will be justly compensated through a million different channels. If one does not expect to be compensated one will be sure to find many reasons to complain. We must first ask for what we think is right and fair compensation. We must also ask, while knowing the channel we are asking could say "no". However, in the process of asking, we are telling ourselves things about ourselves and how much we value ourselves. Ask yourself if you would give yourself or another what you are asking. Keep asking. That does not mean to ask for a million dollars for a job that pays $20 an hour. If you want a million dollars, you might have to change jobs and your state of thinking. Are you ready to do that? The Law of Compensation is a hard and fast spiritual Law that won't bend in order to be "nice", but it will support you in your every thought and demand for your divine exchange. What are workers compensation class codes? This video explains the following: 1.)What are workers compensation class codes? Workers’ compensation class codes are codes that the insurance companies use to identify specific categories of work. For instance, you may know the job duties of a contractor by their job title. However, the insurance company knows them as “5606”. 2.) What is workers’ compensation insurance? Workers' compensation is a form of insurance that provides compensation to employees who suffer job-related injuries and illnesses. In exchange for the possession of workers’ compensation insurance, the state offers a legal surrender of the employee's right to sue his or her employer for the tort of negligence. 3.) Why do insurance companies use workers’ compensation class codes? Insurance companies need to be able to categorize various types of work into “class codes” to determine workers compensation rates, coverages, and exclusions. For example, a 5606  (Contractor) will have a more expensive workers’ compensation rate than an 8810 (Clerical) employee, because more dangerous work is being performed. 4.) How is workers’ compensation insurance charged? Insurance companies assign a unique rate to each client based on the applicable class code, the experience and loss history of the business, amount of employees and payroll, and other factors. The rate is charged as a percentage of payroll applied to the taxable wages paid to employees. For example, a road construction company might have nine employees that are classified as 5506. Let’s say those employees have a workers' compensation rate of $12 per 100. That means that for every $100 of taxable wages paid to those employees, the employer is charged $12 for workers compensation insurance. That same company has one 8810 (Clerical) employee. The 8810 employee has a rate of $0.15 per 100. That means that for every $100 of taxable wages paid to that employee, the employer is charged $0.15 for workers’ compensation insurance. 5.) Why is it important to be correctly classified? In the event of an audit (Or injury that leads to an audit), the carrier may determine that employees were incorrectly classified. If so, the insurance company can retroactively bill the client for up to three years of premium that has been incorrectly classified. If employees are misclassified, the claim frequency and loss ratios will be out-of-line with the norm for that class code. Insurance companies use statisticians to keep track of unusual loss patterns and payroll ratios. They will figure it out eventually, possibly resulting in the outcome from bullet point above. Being incorrectly classified can cause insured’s to get dropped by their carrier. Getting dropped puts companies in a frantic rush to find new coverage, meanwhile, the income-producing functions of the business must come to a halt. When a business then tries to get insurance from another carrier, the first question the new insurance company will ask is “Have you recently been dropped or denied coverage?” If this is true, the insurance company will most likely either refuse to quote or markup the rate due to the increased risk. As a business, the best way to save money on workers’ compensation insurance is to build a long, trusting relationship with the carrier. 6.) Why do some states have different class codes for the same type of work? The rules and regulations for workers’ compensation are unique for every state. Most states utilize the NCCI class code system. With states that use NCCI workers’ compensation class codes, the classifications remain almost entirely the same for each of those states (Except for state specials). However, some states do remain independent, or monopolistic. 7.) How to use the NCCI State Reference Guide To see the governing authority for the workers’ compensation class code list of any US state, you can visit the “NCCI State Reference Guide”. After selecting a state from the drop-down menu, the “State Jurisdiction” row will tell you the name of the organization overseeing the classification system. Additionally, the “Policy Data” row will tell you the organization that is in charge of reporting statistical data for their correlating workers’ compensation “Statistical Plan.” 8.) What is the National Council on Compensation Insurance (NCCI)? NCCI is an independent advisory organization that is primarily funded by insurance companies. Most insurance companies use NCCI for various services, such as collecting and analyzing statistical data for workers’ compensation rates. 9.) What is the NCCI Scopes Manual? The NCCI Scopes Manual is used by insurance professionals (Such as underwriters) to identify the class code associated with each type of occupational work. 10.) Provision of Section 43CA, 50C and 56(2)(x) being amended to allow 5% of sale consideration in variation vis a vis stamp duty value. On account of location, disadvantage etc. Provision of section 40(ia) and 40A(3) and 40A(3A)are being made applicable to Charitable Trust . Hence expenditure incurred without deduction of tax and in cash will not be eligible as application of income under section 10(23C) and section 11(1)(a). Income Computation and Disclosure Standards(ICDS) being given statutory backing in view of decision of Delhi High Court decision. Marked to market loss computed as per ICDS to be allowed under section 36. Gain or loss in Foreign Exchange as per ICDS to be allowed under new section 43AA. Construction Contract income to be computed on percentage completion method as per ICDS. Valuation of Inventorty including Securities to be as per ICDS. Interest on compensation, enhanced compensation. Claim or enhancement claim and subsidy, incentives to be taxed in the year of receipt only as per new Section 145B. Conversion of stock in trade to capital asset to be charged as business income in the year of conversion on Fair Market value on the date of conversion. 54EC benefit of investment in Bonds to be restricted to Capital gain on land and building only. (1) Former Workers Violated Ex-Employer’s Trade Secret Rights - http://bit.ly/1pPhW14 Our top story: The U.S. Court of Appeals for the Sixth Circuit upholds a ruling against ex-employees for a trade secret violation. The Sixth Circuit has upheld a ruling that a group of workers at a fastener company used confidential drawings from the company to design, manufacture, and sell competing parts for their new business venture. On appeal, the former workers argued that they were “filling a gap” for customers, not competing with the original company. But the Sixth Circuit found that this argument ignored undisputed evidence in the case. Peter Steinmeyer, from Epstein Becker Green, has more on what employers can do to protect their trade secrets. On a related note, last week, the House of Representatives passed a bill to federalize trade secrets law. The legislation now heads to President Obama, who has promised to sign it. (2) Financial Regulators Propose Banker Bonus Restrictions - http://bit.ly/1Takw99 U.S. financial regulators seek comments on a proposed rule restricting incentive compensation. Several financial regulatory agencies, including the Federal Deposit Insurance Corporation (FDIC) and the Securities and Exchange Commission, are looking to ensure that incentive compensation balances risk and reward. The proposed rule would require that up to 60 percent of certain compensation be deferred for as long as four years, and firms would have the power to claw back incentive pay for at least seven years. This new proposed rule reflects the 10,000 comments received in response to the original 2011 proposal. (3) D.C. Circuit: Musicians Are Employees - http://bit.ly/23e309H Musicians who perform in seasonal concerts for a Pennsylvania orchestra are employees, not independent contractors. That's according to the D.C. Circuit, which ruled that the orchestra members are indeed employees and have the right to engage in collective bargaining through a union. After noting that there are a variety of “unharmonious” tests for independent contractor status, the D.C. Circuit deferred to the decision of the National Labor Relations Board (NLRB) on the matter, citing court precedent that held that NLRB rulings in cases with conflicting views should stand. (4) NLRB Alleges Misclassification Violates NLRA - http://bit.ly/1r2So1k In California, we’re seeing a new strategy from the NLRB on employee classification. The NLRB’s Los Angeles office is arguing that Intermodal Bridge Transport's alleged misclassification of its drivers as independent contractors is an unfair labor practice because it deprives the drivers of rights granted to employees under the National Labor Relations Act (NLRA). With the continued growth of the “gig” economy, even companies that have taken proper care in the classification of their independent contractors may face NLRB action on this front.
