BOOK REVIEW TOLLEY'S VAT CASES 2011 By Alan Dolton and David Rudling LexisNexis Butterworths ISBN: 978-0-7545-4015-1 www.lexisnexis.co.uk 'THE BIBLE OF THE UK VAT INDUSTRY...' says "The Times" An Appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers "The Times" has already said it... but we cannot help but repeat it: Tolley's VAT Cases 2011 is indeed 'the bible of the UK VAT industry'. Quite an industry it has become too! Since the introduction of VAT in 1973, the resulting thousands of appeal decisions have constituted, in the words of Dolton and Rudling, 'an essential commentary on many aspects of the legislation' as well as 'the impact of the tax on an increasing range of business and private circumstances.' This latest, annually published edition of Tolley's, the twenty-sixth to be precise, contains entries for over 4,000 cases in nearly 2,000 pages. The title is fully comprehensive, comprising public court and tribunal decisions relevant to current VAT legislation. The subtitle of the volume is self-explanatory. It's indeed 'a comprehensive digest of reported value added tax decisions relevant to current legislation from 1973 to January 2011' and just what we need as practitioners. A definitive work of reference though it is, this Tolley publication certainly reveals the vicissitudes of business life and the human condition as we know it. What excuses, for example, for late submission of your VAT return will the tribunal accept, or not? The section on 'Default Surcharge: whether a 'reasonable excuse' covers case after case on this issue to great effect. Death is usually a reasonable excuse (although it would probably be foolhardy to assume always!). Pregnancy and its complications is often a 'reasonable excuse', but again, not always -- especially in the instance of a trader's wife who gave birth to a daughter less than four weeks before the (VAT) return was due. The trader's appeal against a default surcharge for submitting the return late was dismissed, the child's birth, said the tribunal 'was an event which must have been anticipated for a considerable period.' Putting all this aside, no tax practitioner or lawyer active in this field should be without the latest edition of 'Tolley's VAT Cases'. The book is also the ideal reference for accountants, students, company secretaries, or anyone in any way involved in VAT. The publication 'VAT Intelligence' has described the indexing system as 'far easier to use than the (official) index to the VAT tribunal decisions' which is a telling statement, indeed. This latest edition contains much new material. The chapters on 'Appeals', 'Business' and 'European Community Law' have been expanded and there are summaries of more than 50 court decisions and over 100 decisions reached in 2010, plus an introductory survey discussing the most important of these decisions. For ease of reference, there are three ways, basically, to look things up: the Contents List at the beginning of the book, the very extensive Table of Statues, and the equally extensive general subject index at the back. So, if you're involved professionally in this often complex area, 'Tolley's VAT Cases' in the most up-to-date edition should be an essential purchase living up to its description in 'The Times' as the UK VAT industry bible, and very grateful we are for it in this area of practice.

Payments by Check in Priority's ERP Solution
Priority offers two options for recording payments to vendors: check payments and bank transfers. Payments may be made against specific invoices or they may be unrelated to any particular invoice. They can be prepared automatically in batches or manually per payment document. Once the payment has been checked, authorized and finalized, a journal entry is created that credits the vendor's account. Consequently, the invoices for which the payment is being made are automatically reconciled with the payment. Checks and bank transfer instructions can be printed once payment has been finalized. The check printing mechanism in Priority ensures that you can only print those checks that appear in finalized payment documents and which have not yet been printed. The program enables the user to select the maximum number of checks to print at any one time (useful, for instance, when there are only five checks left in the printer whereas there are ten that need to be printed). The program also displays the number of the next check to be printed. If the latter does not tally with the first number on the checks in the printer, it may be revised. One of the financial constants determines the number of check copies that can be printed at any given time, while another determines the maximum number of characters that fit on a single line of a check.

It's a very complicated video to watch, but, for those aware of the case it shows how she seems to have knowledge of what happened but has not been kept in the 'loop' enough to avoid conflicting statements with the others... 1) Rachael has the day of the tennis wrong... - Madeleine's group played on Tuesday, not Thursday 2) Rachael claims she chatted with Kate from 9.30 - 10.00am by the pool until Madeleine arrived for lessons.... - Kate played tennis from 9.15am to 10.15am so (whether Tuesday or Thursday) would not be lounging by the pool chatting with Rachael any time prior to 10.15am. - On Tuesday (the correct mini tennis day), Kate went back to the apartment as the maintenance men were fixing the shutter that Gerry had broken and also showed Kate how to use the washing machine, so, even if rushing, she would not have had time to relax and chat with Rachael prior to mini tennis in the 15 minutes between her lesson and Madeleine arriving. 3) Rachael claims that both Gerry and Kate were there, with her, when Madeleine arrived for mini tennis...... - Gerry played tennis from 10.15 - 11.15am on the other tennis court and could NOT have been present. - Kate claims in her book that she returned from the apartment leaving the maintenance men fixing the shutters and returned DURING Gerry's tennis lesson (which finished 15 minutes AFTER mini tennis was finished. 4) Rachael claims the last time she saw Madeleine was at mini tennis... - Mini tennis was on Tuesday so was the last time she saw Madeleine on TUESDAY? - Jane Tanner last saw Madeleine when she was playing tennis with Rachael at lunchtime on Thursday, at the time the Last Picture was taken. Jane claims that Gerry and Madeleine were shouting at them from the rec area.....Rachael makes no mention of seeing the children (including Madeleine) and does not claim to have seem Madeleine for the last time during their game. 5) The police ask Rachael which tennis court the children played on... - Rachael describes Court 1 but the children played on Court 2..but WHY did the police ask her that question? (Because they suspected she was not there?) Rachaels statement deserves closer scrutiny imo. I was not aware of some of the details above until compiling the video and considering these details only relate to mini tennis one has to wonder about the rest of her statement. This is not a video for casual observers of the case. It may be too complicated to watch for some people. My intention is to have it as a reference for those that are studying the discrepancies and, along with the rest of the series of videos, (yet to be completed) a possible reminder for the 'authorities' involved in the case.

The accounting equation is what keeps all of the transactions in balance and helps users of the information make sense of what areas each transaction affects. The financial position of any company is based on the following items: Assets: what the company owns Liabilities: what the company owes to other parties Owners' Equity: the difference between assets and liabilities The Accounting Equation The basic accounting equation simplifies our understanding of how these three areas of the company relate to each other. The basic accounting equation for any given business is: Assets = Liabilities + Owners' Equity Assets are the things that the company owns, or its resources. Assets are things like cash, accounts receivable, inventory, prepaid insurance, buildings & equipment, land, and goodwill. Remember that total assets will always equal liabilities + owners' equity. That's exactly what a balance sheet means... because the assets, or the left side of the balance sheet, will always equal liabilities + owners' equity, or the right side of the balance sheet. Liabilities are the company's obligations, or the amounts that the company still has to repay to other parties. Liabilities can be notes payable, accounts payable, wages payable, interest payable, bonds payable, or income taxes payable. Liabilities can be viewed as bills that the company has to pay, or as the part of the source of acquiring their assets. For example, if the company bought a new delivery truck for $20,000 using a $20,000 loan from the bank, then the company has an asset of $20,000, as well as a liability of $20,000 to pay back to the bank. Notice that the asset equals the liability in this example. Owners' equity is the amounts invested by the owners of the company plus the cumulative net income that hasn't been taken out or distributed as dividends to the owners of the company. Difference Between the Balance Sheet and the Income Statement As we already mentioned, the balance sheet is called the balance sheet because the accounting equation will always balance... meaning the assets side of the balance sheet will always equal the same as the liabilities + owners' equity. There is also a big difference in the format of the balance sheet versus the income statement. The balance sheet gives a company's financial position at any given point in time, where as the income statement is a report of activities over a given time period.
